NYS Public Service Commission Considers A Delay Of The State's Renewable Energy Deadlines

ESEA

Based on the state's electric reliability issues and the concerns with ever increasing energy costs, a coalition of 30 industries filed a petition in January with the New York State Public Service Commission seeking a pause of the state's renewable energy programs. The CLCPA allows the PSC to temporarily suspend or alter plans if renewable mandates jeopardize reliability.

The petition filed by the Coalition for Safe and Reliable Energy on January 6, 2026, states:

"Given recent evidence regarding delayed renewable energy generation and risks to reliability, the Commission should hold a hearing pursuant to PSL § 66-p (4) to determine whether safe and adequate electric service in New York is impeded by the Renewable Energy Program and, if so, to appropriately modify or suspend the program's obligations." The petition contains a description of the Coalition members (including the Business Council and two members of the Climate Action Council).

Following receipt of the petition the Commission issued a Notice on January 28, 2026, seeking public comments which are due March 30, 2026.

ESEA is in the process of reviewing the petition and the PSC Notice.
